Cortez<\/figcaption><\/figure>\n<\/div>\n<p class=\"wp-block-paragraph\">Last week, Hidalgo County became the first entity to join the South Texas Water Supply Council, which is hoping to bring together other South Texas border counties and essentially any entity responsible for providing water to people into a bloc that can pursue water projects at scale, advocate for the area and think long term about potential solutions to the region\u2019s growing water crisis.<\/p>\n\n<p class=\"wp-block-paragraph\">\u201cThis is a very serious initiative,\u201d Hidalgo County Judge Richard F. Cortez said after commissioners court voted to join the council. \u201cI think it\u2019s a good move for us to look at different alternatives and then pick the best one.\u201d<\/p>\n\n<p class=\"wp-block-paragraph\">The council is being organized by David Earl, an attorney who\u2019s been practicing water law for about 35 years.<\/p>\n\n<p class=\"wp-block-paragraph\">Previously, Earl worked with the city of San Antonio\u2019s water system and is active in Webb County\u2019s <a href=\"https:\/\/www.lmtonline.com\/local\/article\/laredo-webb-county-gma13-water-dispute-galo-neeb-22253846.php\">ongoing efforts<\/a> to address its water issues.<\/p>\n\n<p class=\"wp-block-paragraph\">Earl got his start working in the Rio Grande Valley for developer Mike Rhodes, representing him for economic development and utility planning issues with projects that included Tres Lagos in McAllen. He\u2019s also worked with several local cities.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"alignright size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"403\" height=\"643\" src=\"https:\/\/www.rgvbusinessjournal.com\/wp-content\/uploads\/2026\/06\/David-Earl-img-640w.jpeg\" alt=\"David Earl\" class=\"wp-image-17535\" style=\"aspect-ratio:0.6267799853661282;width:162px;height:auto\" srcset=\"https:\/\/www.rgvbusinessjournal.com\/wp-content\/uploads\/2026\/06\/David-Earl-img-640w.jpeg 403w, https:\/\/www.rgvbusinessjournal.com\/wp-content\/uploads\/2026\/06\/David-Earl-img-640w-188x300.jpeg 188w, https:\/\/www.rgvbusinessjournal.com\/wp-content\/uploads\/2026\/06\/David-Earl-img-640w-304x485.jpeg 304w, https:\/\/www.rgvbusinessjournal.com\/wp-content\/uploads\/2026\/06\/David-Earl-img-640w-144x230.jpeg 144w\" sizes=\"auto, (max-width: 403px) 100vw, 403px\" \/><figcaption class=\"wp-element-caption\">David Earl<\/figcaption><\/figure>\n<\/div>\n<p class=\"wp-block-paragraph\">Earl says he\u2019s putting together the South Texas Water Supply Council pro bono.<\/p>\n\n<p class=\"wp-block-paragraph\">\u201cI see how people are suffering along the border with water rationing and restrictions,\u201d he said. \u201cIn Laredo they\u2019re at a point where they\u2019re about to start rationing how many showers you can take a week.\u201d<\/p>\n\n<p class=\"wp-block-paragraph\">Earl says South Texas border communities have a disadvantage in addressing the water crisis.<\/p>\n\n<p class=\"wp-block-paragraph\">The Texas Water Development Board splits the state into <a href=\"https:\/\/twon.tamu.edu\/wp-content\/uploads\/sites\/3\/2021\/06\/question-about-gcds.pdf\">16 regional water planning groups<\/a>.<\/p>\n\n<p class=\"wp-block-paragraph\">South Texas\u2019 border counties \u2014 from Cameron County up to Maverick County \u2014\u00a0are represented by the Rio Grande Regional Water Planning Group, or Region M.\u00a0<\/p>\n\n<p class=\"wp-block-paragraph\">However, the Water Development Board also divides the state into groundwater management areas.<\/p>\n\n<p class=\"wp-block-paragraph\">Texas has 98 groundwater conservation districts that cover <a href=\"https:\/\/www.texastribune.org\/2025\/11\/07\/texas-water-questions-answered\/\">almost 70% of the state<\/a>.<\/p>\n\n<p class=\"wp-block-paragraph\">All of those districts are part of at least one of the state\u2019s 16 groundwater management areas.<\/p>\n\n<p class=\"wp-block-paragraph\">Region M \u2014\u00a0the South Texas border counties \u2014 is split into two of those: Areas 13 and 16.\u00a0<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"alignright size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"768\" src=\"https:\/\/www.rgvbusinessjournal.com\/wp-content\/uploads\/2026\/04\/IMG_9041-1024x768.jpeg\" alt=\"Wide drainage canal in Hidalgo County showing expanded banks and increased capacity to manage stormwater runoff.\" class=\"wp-image-11093\" style=\"width:440px;height:auto\" srcset=\"https:\/\/www.rgvbusinessjournal.com\/wp-content\/uploads\/2026\/04\/IMG_9041-1024x768.jpeg 1024w, https:\/\/www.rgvbusinessjournal.com\/wp-content\/uploads\/2026\/04\/IMG_9041-300x225.jpeg 300w, https:\/\/www.rgvbusinessjournal.com\/wp-content\/uploads\/2026\/04\/IMG_9041-768x576.jpeg 768w, https:\/\/www.rgvbusinessjournal.com\/wp-content\/uploads\/2026\/04\/IMG_9041-1536x1152.jpeg 1536w, https:\/\/www.rgvbusinessjournal.com\/wp-content\/uploads\/2026\/04\/IMG_9041-2048x1536.jpeg 2048w, https:\/\/www.rgvbusinessjournal.com\/wp-content\/uploads\/2026\/04\/IMG_9041-1067x800.jpeg 1067w, https:\/\/www.rgvbusinessjournal.com\/wp-content\/uploads\/2026\/04\/IMG_9041-647x485.jpeg 647w, https:\/\/www.rgvbusinessjournal.com\/wp-content\/uploads\/2026\/04\/IMG_9041-307x230.jpeg 307w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><figcaption class=\"wp-element-caption\">An expanded drainage channel in Hidalgo County.<br\/>Photo Credit | Matt Wilson<\/figcaption><\/figure>\n<\/div>\n<p class=\"wp-block-paragraph\">None of the current representatives of those areas\u2019 boards actually live in Region M or represent any of South Texas\u2019 border counties\u2019 groundwater districts, perhaps because South Texas has so few groundwater development districts.<\/p>\n\n<p class=\"wp-block-paragraph\">\u201cMost of those counties have historically been dependent 100% on water from the Rio Grande River,\u201d Earl said. \u201cBecause of that, they\u2019ve never done groundwater conservation districts. Most of them, historically.\u201d<\/p>\n\n<p class=\"wp-block-paragraph\">There\u2019s only two groundwater development districts in Region M: the Red Sands GCD \u2014 perhaps the smallest district in the state \u2014 which covers a fragmented area in the northern part of Hidalgo County and another district that covers all of Starr County.<\/p>\n\n<p class=\"wp-block-paragraph\">What does all of that mean for South Texas\u2019 border counties?\u00a0<\/p>\n\n<p class=\"wp-block-paragraph\">According to Earl, it means South Texas\u2019 border counties have less of a seat at the table when it comes to groundwater issues compared to their northern neighbors.<\/p>\n\n<p class=\"wp-block-paragraph\">\u201cBecause they\u2019ve never done groundwater conservation districts, they have no membership in the groundwater management areas, which are bodies that are created by Chapter 36 of the Water Code to form and implement the state water plan,\u201d he said.<\/p>\n\n<p class=\"wp-block-paragraph\">The South Texas Water Supply Council, Earl thinks, can counterbalance that disadvantage by knitting together a wide swath of the border he says is underrepresented on groundwater issues as groundwater resources are becoming <a href=\"https:\/\/www.texasobserver.org\/corpus-christi-water-crisis-aquifers\/\">increasingly lucrative<\/a>.<\/p>\n\n<p class=\"wp-block-paragraph\">\u201cThe whole idea is to get these groups together and work together collaboratively to find ways to bring water from where it\u2019s at to where it\u2019s needed at the lowest price to the consumer,\u201d he said. \u201cAnd also to give the folks around the Rio Grande river, the communities, a voice in water planning because they really lack that voice right now, to a certain extent.\u201d<\/p>\n\n<p class=\"wp-block-paragraph\">Earl says there\u2019s other reasons to cooperate. He sang a tune that will be familiar to anyone who\u2019s paid attention to Valley economic development \u2014 or really Valley news \u2014 in the past several years.<\/p>\n\n<p class=\"wp-block-paragraph\">RioPlex advocates for economic development on a regional level in the Valley, the RGV Metropolitan Planning Organization does the same for transportation issues and the region\u2019s four county judges loosely banded together to advocate for needs during the coronavirus pandemic and screwworm\u2019s reintroduction to South Texas.<\/p>\n\n<p class=\"wp-block-paragraph\">Earl says the idea behind the council isn\u2019t any different: big and small, South Texas\u2019 myriad entities have a stronger voice together than apart.<\/p>\n\n<p class=\"wp-block-paragraph\">\u201cThat\u2019s the intention behind it, is to help these smaller communities along the border coalesce together and create a cooperative so they have more legislative attention,\u201d he said. \u201cThey have a louder voice at the table. They have a way to come together for more bargaining power, more purchasing power and can drive down the cost of water, no matter where it comes from. Water shortages have <a href=\"https:\/\/www.rgvbusinessjournal.com\/news\/25\/09\/2025\/rio-grande-valley-citrus-growers-grapple-with-shrinking-industry\/\">crippled agriculture<\/a> in the Valley. Texas is <a href=\"https:\/\/www.texastribune.org\/2025\/03\/13\/texas-water-explained-supply-demand\/\">running out of water<\/a>.<\/p>\n\n<p class=\"wp-block-paragraph\">This spring, the state estimated the <a href=\"https:\/\/www.texastribune.org\/2026\/04\/16\/texas-water-supply-crisis-corpus-christi-development-board\/\">cost of avoiding<\/a> a severe water crisis at $174 billion.<\/p>\n\n<p class=\"wp-block-paragraph\">Funding that the state\u2019s already approved and the crisis have led to a glut of <a href=\"https:\/\/www.rgvbusinessjournal.com\/news\/24\/06\/2026\/south-padre-island-desalination-project-permits\/\">water projects<\/a> in Texas.<br\/>\u201cIt is a gold rush. And it\u2019s hard,\u201d Earl said. \u201cYou\u2019ve gotta have a plan. If you don\u2019t have a plan, you\u2019re wasting your money.\u201d<\/p>\n\n<p class=\"wp-block-paragraph\">Earl wants the council to help entities plan efficiently and long term.<\/p>\n\n<p class=\"wp-block-paragraph\">\u201cThese water projects can\u2019t be flipped on overnight,\u201d he said. \u201cThey take years and years to plan and design and fund to make sure they\u2019re meaningful and good.\u201d<\/p>\n\n<p class=\"wp-block-paragraph\">To buy into the South Texas Water Supply Council, Hidalgo County agreed to pay $5,000.\u00a0<\/p>\n\n<p class=\"wp-block-paragraph\">That gives it the right to take a council seat, receive funding assistance and plan.<\/p>\n\n<p class=\"wp-block-paragraph\">The county \u2014 and any subsequent members \u2013 could fork over more money to pursue studies or water supply projects.<\/p>\n\n<p class=\"wp-block-paragraph\">According to Earl, the nascent council planned to speak with the city of McAllen
